When do I need a waiver? A waiver is required for certain criminal convictions for which a waiver is available. Some waivers are only available for family members of US citizens or green card holders. Others are for those who tried to enter the US on the wrong visa and whom the US government decided were trying to settle here permanently without first applying for an immigrant visa.
